Extradition Act, 1870, merely requires him to issue s warrant for the apprehension of the accused pèrvon. In this case the Magistrate appears to have done so, and his error, if any, consists, not in disregarding the Governor's Warrant, but in refusing to consider the case on its merita under Sections 9 and 10 of the Act. In considering the question of the possibility of obtaining a writ of mandemus, this point is of some importance.
